— Appeal from an order of the Supreme Court at Special Term (Connor, J.), entered October 19, 1983 in Albany County, which, inter alia, granted petitioner’s application pursuant to subdivision 5 of section 50-e of the General Municipal Law for leave to file a late notice of claim. 11 On or about October 5, 1977, when petitioner Joseph Welsh was 12 years of age, he was injured during a regularly scheduled gym class.
