Rumsfeld, Secretary, Department of Defense’s (“Rumsfeld”) Motion for Partial Dismissal (# 35) and Motion for Summary Judgment (# 41) as well as Plaintiff Clara Eugene’s (“Eugene”) Motion for Partial Summary Judgment (# 43).
