Appeal by the People from an order of the Supreme Court, Kings County (Bianchi, J.), rendered December 15, 1988, which granted the defendant’s motion pursuant to CPL 330.30 (1) to set aside a jury verdict finding the defendant guilty of attempted rape in the first degree and assault in the second degree.

Ordered that the order is modified, on the law, by deleting the provision thereof which granted that branch of the motion which was to set aside the jury verdict finding the defendant guilty of attempted rape in the first degree and substituting therefor a provision denying that branch of the…
