*464Appeal by the defendant from, a judgment of the Supreme Court, Queens County (Blumenfeld, J.), rendered July 8, 2003, convicting him of assault in the second degree and criminal pos - session of a weapon in the fourth degree, upon a jury verdict, and imposing sentence.

Ordered that the judgment is modified, on the law, by reduc - ing the defendant’s conviction of assault in the second degree to attempted assault in the second degree and vacating the sentence imposed thereon; as so modified, the judgment is affirmed, and the matter is remitted to the Supreme Court, Queens County, for…
