In an action, inter alia, to recover damages for breach of contract, the defendant appeals from a judgment of the Supreme Court, Nassau County (Galasso, J.), entered June 3, 2014, which, upon a jury verdict, is in favor of the plaintiff and against him in the principal sum of $53,300.

Ordered that the judgment is modified, on the law and the facts, by deleting the provision thereof awarding the plaintiff the principal sum of $53,300, and substituting therefor a provision awarding the plaintiff the principal sum of $33,300; as so modified, the judgment is affirmed, without costs or…
