At the time the accused enlisted in the United States Army, he had just passed his seventeenth birthday. He served satisfactorily and without incident for some six months, at which time he was charged with having committed the offense of taking indecent liberties with a thirteen-year-old boy, in violation of Article 134, Uniform Code of Military Justice, 10 USC § 934.
