Appeal from circuit court, New York county. Action by Nathaniel Jarvis, Jr., against the Manhattan Beach Company. From a judgment entered on a verdict in favor of plaintiff, and from an order denying a motion for a new trial, defendant appeals.

The facts appearing upon the former appeal and. the decision of this court thereon will be found reported in 53 Hun, 362, 6 N. Y. Supp. 703. So far as the same questions are here involved, that decision is controlling. In accordance with the views expressed in the opinion, the question of fact as to whether or not the representations as to the validity of the certificate on which Fox & Co. relied were actually made by the defendant was submitted to the jury, and their finding in plaintiff’s favor is conclusive.
