The plaintiff’s claim was for a balance due on a written contract between the plaintiff and the defend ant for the excavation of cellars and the construction of stone foundations for thirty dwelling houses, about to be erected by the defendant on a plot of ground in the City of Philadelphia. The work was to be done according to plans and specifications adopted — the necessary material to be supplied by the plaintiff.
