The plaintiff in error was plaintiff in the court below. Elizabeth Jane Williams will be referred to herein as the defendant.

The plaintiff, Dudley A. Williams, brought this suit, praying that the marriage between his uncle, Benjamin M. Williams, deceased, and the defendant, Elizabeth Jane Williams, be declared void on the ground of fraud practiced by the defendant upon the deceased, who it is alleged was a mental incompetent, and incapable of entering into a marriage contract.
