GOODE, J. —

On December 3, 1901, James F. Smith, was appointed curator of the estate of Irvin Padgett by the probate court of Scotland county and duly qualified, executing a bond for $5,000 with W. H. F. Smith and J. E. Smith as sureties. The condition of the bond was that said James F. Smith should faithfully perform and discharge his duties as curator according to law. On December 10, 1903, said James F. Smith was removed from the curatorship by the probate court of Scotland county and from the order of removal he appealed to the circuit court of said county, where the order was affirmed,…
