The defendant was convicted of manslaughter in causing tbe death by drowning of one Dorothy Lynn Smith. From judgment imposing prison sentence the defendant appealed.

The question chiefly debated here was whether the evidence was sufli-cient to sustain the charge of involuntary manslaughter. The State’s evidence tended to show that on 1 September, 1947, several woman and children were bathing in West End pond which was shallow near the banks, but deepened to 10 or 12 feet in the center.
