BROWN, Justice.
This is an unusual child custody case. The appellee, Texas Children’s Home & Aid Society, filed a petition for a writ of habeas corpus in the 96th Judicial District Court in which the petition alleged that it is duly incorporated under the laws of the State of Texas, “engaged in work throughout the State of Texas for the benefit of orphans, dependent and neglected children,” and that early in the year 1944, the defendant (appellant here) R.
