Appeal from a judgment of the County Court of Albany County (Turner, Jr., J.), rendered October 1, 1993, upon a verdict convicting defendant of the crime of robbery in the second degree.

The preliminary issue on appeal is defendant’s contention that he was denied the right to effective assistance of counsel due to counsel’s failure to move to dismiss the indictment charging him with a felony for noncompliance with statutory speedy trial requirements (see, CPL 30.30 [1] [a]).
