1. Tbe Court of Appeals has requested instructions upon certain questions of law, the nature of which will sufficiently appear from the opinion following.
The exception was to a judgment refusing a new trial, in which the defendants complained of-the direction of a verdict for the plaintiff. The suit was against a surety company that had become surety on the official bond of a sheriff, and against the administrator upon the estate of the executrix of the will of the sheriff, she being also his sole legatee.
