The defendant Henry O'. Duncan was appointed special administrator of the estate of Samuel Leroy Duncan, deceased, on March 7, 1923, in Brown county, and on the same day qualified with the Fidelity & Deposit Company of Maryland as surety on his official bond. Samuel Leroy Duncan was employed as a mechanic in the yards and shops of the Chicago, Milwaukee & St. Paul Railway Company at Aberdeen, S. D.
