Just before the trial of Lyttleton Knights and his co-defendants was scheduled to begin, Knights pled guilty and agreed to cooperate by testifying against one of the co-defendants. The plea agreement provided that the government would move for a “substantial assistance” downward departure under § 5K1.1 of the sentencing guidelines if the prosecution, in its “sole and unfettered discretion”, was satisfied with Knights’s cooperation.
