Appellee, P. L. O’Hara, brought this action to recover damages for personal injuries sustained in September, 1902, while in the employ of the appellant. He was working in the screen room of its ore mill at Colorado City. The injury is alleged to have resulted through the negligence of the- appellant in not enclosing the end of a revolving shaft and’setscrew with a screen covering, and in leaving'them 'exposed.
