MEMORANDUM OPINION

JAMESON, Chief Judge.

This is an action for personal injuries sustained by plaintiff on December 13, 1965, near Buffalo, South Dakota. Plaintiff was employed by defendant as a “rough neck” or general oil field laborer. He alleges that the injuries resulted from negligent acts of the defendant, his employer.

Defendant has moved for summary judgment on the grounds (1) that the action is barred by the terms of the Workmen’s Compensation Act of Montana; arid (2) that if the Montana Act is inapplicable, the action is barred by the terms of the Workmen’s Compensation Act of South…
