I. INTRODUCTION

The Director of Revenue (Director) appeals the judgment of the Circuit Court of St. Louis County setting aside the Director’s revocation of the driving privileges of Adam F. Cortner (Cortner) and ordering reinstatement of his driving privileges. The Director argues that the trial court erred in reinstating Cortner’s driving privileges because his refusal to submit to a chemical test of his breath, after Cortner asked to speak with his attorney and officers provided him with a telephone and a telephone book for twenty minutes, constituted a refusal…
