Before the court are: (1) Defendant Mitsubishi Aircraft Corporation America, Inc.'s ("MITAC America") motion to dismiss certain claims (MITACA MTD (Dkt. # 54)); and (2) Defendants Aerospace Testing Engineering & Certification, Inc.
