Joseph Age was an employe of the Louisville & Nashville Bailroad Company as section foreman at Glasgow Junction, Kentucky. On the afternoon of October 8, 1910, he was run over by one of the cars of the defendant company and so seriously injured that he died on the following morning. Charging that his death was 'due to the negligence of the company in the operation of its train, his administrator sued to recover damages therefor.
