This is an action for personal injuries alleged to have been received through the negligence of defendant while plaintiff was working in a-bin shoveling crushed rock. Verdict was for plaintiff in the sum of $12,500 but the trial court required a remittitur of $5000, and after motions in defendant’s behalf for a new trial and in arrest of judgment had been overruled, judgment was entered for $7500. Defendant appeals.
