This suit was brought by appellees against the appellant in a justice court of Newton county. Plaintiffs’ original petition filed in the justice court on August 29, 1911, contains the following allegations and prayer: “That heretofore, to wit, on the 30th day of August, 1907, defendant executed and delivered to plaintiff his obligation in writing to pay to plaintiff in the sum of $200, which obligation was given for $200 in cash, which plaintiff delivered to defendant to be kepi for plaintiff by defendant subject to her order; fhat at the time of receiving said $200 defendant agreed to pay…
