Defendant (First Citizens Bank) appeals from summary judgment in favor of plaintiff (Samuel James Thompson), entered 15 May 2001. We affirm the trial court.

On 5 November 1998, plaintiff borrowed $10,500 from defendant. As collateral for the loan, defendant required plaintiff to purchase a $10,000 certificate of deposit (CD). Plaintiff met with Catherine Huggins (Huggins), defendant’s employee, to execute the documents associated with the loan and with the purchase of the CD.
