(dissenting) : It appears to me that the cardinal underlying issue made by the appeal herein has been misunderstood, and hence improperly decided upon inapplicable principles of law. I must, therefore, state the reasons for my dissent from the leading opinion.

The plaintiff with the most meticulous care, and in explicit language, charges a joint tort against the three defendants. He so alleges the facts as to show the close interrelation of the actions of each defendant leading to the resultant injury, of which the plaintiff complains.
