(dissenting). The record in this case discloses that on July 7, 1925, J. W. Little entered into a contract with Gosdin Brothers to erect a store building in the city of Madill, Okla., for the principal sum of $9,000. That on the 17th day of July, 1925, the Federal Surety Company executed a bond in the sum of $2,500 with said Gosdin Brothers, as principal, said surety company as sureties, and J. W. Little the obligee in said bond, for the payment to the said J. W. Little against any loss or damages directly arising by reason of the failure of said Gosdin Brothers to faithfully…
