POLLOCK, District Judge.
This is an action to recover war risk insurance. The pleadings disclose:
That the plaintiff entered the United States Army on May 27, 1918, at Camp Funston, and thereafter, and until April 1, 1919, at which date he was granted an honorable discharge, ho was in the active service of the United States Army. That while in said military service, on or about the 15th of June, 1918, ho applied for and was granted insurance in the sum of $10,000, pursuant to the provisions of the act of Congress commonly known as the War Risk Insurance Act, approved October 6, 1917 (Comp.
