Five defendants were convicted of murder in the first degree, the jury recommending life imprisonment. Upon appeal, the judgments entered were modified and the cause was remanded to the trial court with directions to pronounce judgment against each of these defendants as for murder in the second degree. (People v. Cowan, 38 Cal. App. (2d) 231 [101 Pac. (2d) 125].) This was done and three of these defendants again appealed from the judgments thus entered.
