This is an action in bail-trover, for the recovery of an electrical musical instrument, sold by the plaintiff to the defendant under a contract in which title to the instrument was retained in the vendor until payment of the purchase price. It was shown that the plaintiff knew, at the time the instrument was sold, that it was intended to be used by thé defendant in a lewd house for the purpose of attracting men thereto; and when the case was formerly before this court (Harris v.
