Appeal from a judgment of the Supreme Court (Lamont, J.), rendered August 25, 1999 in Albany County, upon a verdict convicting defendant of the crimes of burglary in the third degree and petit larceny.

Defendant was indicted on charges of burglary in the third *743degree and petit larceny after a City of Albany police officer found him in the backyard of an automobile service business, at night, standing behind a pickup truck containing assorted auto parts.
