Plaintiffs deceased husband, John Wells, was engaged in moving a duck house owned by his employer on the employer’s property. Wells was instructed not to perform the task on the day of the accident, which forms the basis of this suit, because of the poor weather conditions, which were blizzard-like. The duck house was approximately 75 feet away from a pond located on the farm property. Wells was familiar with the location of the pond on the property. The pond was partially visible even though it was frozen and covered with snow.
