I. INTRODUCTION

Plaintiff Stacey Pompey-Howard commenced this action against defendant New York State Education Department (“NYSED”) alleging discrimination on the basis of race and retaliation in violation of Title VII, 42 U.S.C. ;§ 2000e et seq., 42 U.S.C. § 1981, and the -New York State Human Rights Law (“NYSHRL”), N.Y.
