Appeal from Pottawattamie District Court. — O. D. . Wheeler, Judge. Suit in equity for rescission, and to recover the purchase price paid for a tract of land in Colorado. The facts are fully stated in the opinion. There was a decree in favor of plaintiff, as prayed, and defendant appeals.

The issues may be more easily stated and understood if preceded by a brief statement of a few of the more important facts. A corporation known as the Antero *425& Lost Park Reservoir Company was organized under the laws of Colorado in 1907 for the purpose of taking over the Antero and Lost Park reservoirs, used for storing water for irrigation purposes, the former being then in process of construction, from the High-Line Reservoir Company, a corporation owning the same.
