Defendant Hatzlachh Supply, Inc. (“Hat-zlachh”) has moved, pursuant to Fed.R.Civ.P. 56(c), for summary judgment. For the reasons hereinafter stated, defendant’s motion is granted.

BACKGROUND

Plaintiff, Zim Israel Navigation Co., Ltd. (“Zim”), is the owner of the container ship Zim Montreal. During October and November 1981, cargo from various ports in the Far East was loaded onto the Zim Montreal to be shipped to ports in North America and Europe.
