MURRAY, Justice.

This is an appeal from a judgment in the district court of Shelby County in favor of appellee and against appellant in a workman’s compensation case.

The case was tried to a jury and resulted in a verdict wherein the jury found in response to special issues that Jones, ap-pellee, suffered an injury while in the course of his employment; that such injury resulted in incapacity to labor; that such incapacity was total for a period of 12 months, beginning on the date of the injury; that such incapacity was partial to the extent of fifty per cent for the rest of his life, beginning…
