The chancellor having dismissed the complainant’s bill for want of equity, its allegations are to be taken as true. W e shall, therefore, in this opinion, speak of and treat them as facts.
The complainant, John Shackelford, and Maria L. Turner, were married on the 25th January, 1842. The terms of a contract were agreed upon between them before the marriage, and were committed to writing.
