Affirming.

On the 19th day of March, 1923, the appellants made a contract with D. C. Clarke, by the terms of which they placed in his hands approximately 370 acres of land on the Shelbyville pike in Jefferson county “for the purpose of subdividing into lots or tracts, developing, ad^ vertising, and selling according to and in the manner in which party of the second part is accustomed to subdividing, developing, advertising, and selling similar tracts.” Clarke was to pay all expenses, and for his services he was to receive 7% per cent, of the gross amount of…
