The appellant, plaintiff below, filed two suits in the district court of Cooke county against W. O. Davis, appellee, on the 6th day of July, 1927. In both eases appellant sought to recover damages for alleged libelous statements published in the newspapes. Upon motion, tlie court consolidated tlie eases, and they were tried together. Tl.e case was submitted to a jury upon a general charge. There was a verdict and judgment for the defendant, from which the plaintiff, Moore, has appealed.
The court did not order the parties to replead. This should have been done. Wright v. Chandler…
