James Lee Percy appeals from the district court’s dismissal of his claim under 42 U.S.C. § 1983 against San Francisco General Hospital and the City and County of San Francisco (collectively referred to as “City”). Percy stated his section 1983 claim in a first amended complaint filed after the statute of limitations had run. The district court determined that the 1983 claim did not “relate back” to the date Percy filed his original complaint.
