The district court of Lyon county, at the March Term, 1882, granted the defendant Railroad Company a new trial, which order the plaintiff Brown, as administrator of the estate of William Haas, deceased, brings here for reversal. The facts appear in A. T. & S. F. Rid. Co. v. Brown, Adm’r, 26 Kas. 443, et seq., and in the opinion, infra.

This was an action brought by Joseph Brown, as administrator of the estate of William Haas, deceased, against the Atchison, Topeka & Santa Fé railroad company, to recover damages alleged to have resulted from the negligence *187of the defendant in wrongfully causing the death of said Haas. A trial was had at the March term, 1882, of the district court of Lyon county, before the court and a jury, which resulted in a verdict in favor of the plaintiff and against the defendant, for the sum of $7,000 damages.
