A civil action by Robert Terrell against Robert Allan et al. This appeal involves only the rights of Robert Terrell and Robert Allan, who wid be hereinafter referred to respectively as plaintiff and defendant, in the order in which they appeared in the trial court.

So much of the petition as may be necessary for a decision of this cause is as follows: That on or about July 5, 1921, Harry Gallaber executed and delivered to Robert Allan a promissory note for $3,500. a copy of which was attached to plaintiff’s petition, and -for the purpose of securing the payment of said note a…
