This is the second case we decide today involving a challenge to Presidential authority under the Antiquities Act of 1906 (“Act”), 16 U.S.C. § 431 (2000). In Mountain States v. Bush, 306 F.3d 1132 (D.C.Cir.2002), the court, upon de novo review, affirmed the dismissal of the complaint, holding that the complaint, which challenged a series of monument designations under the Act, contained insufficient factual allegations under Federal Rule of Civil Procedure 8(a) to trigger ultra vires review of the President’s…
