The appellants, Alexander Weldon and William' Burroughs, were convicted of the murder of Elihu M-oye, and are under sentence of 'death. By a former appeal, the defendants sought a new trial' in this Count on the ground that they had not had a fair trial, without having made a motion in the Court of General Sessions on that ground; hut the appeal was dismissed as premature, without prejudice to the right of the defendants- fo move for a mew trial in the- Circuit Count.
