Plaintiff in error, Louis Freedman, hereinafter called defendant, was indicted and tried before a jury in the criminal court of Cook County on a statutory charge of taking immoral, improper and indecent liberties with a certain female child of three years of age, in violation of the Criminal Code. (Ill. Rev. Stat. 1953, chap. 38, par. 109.) His motions for a directed verdict at the close of the prosecution’s case and at the close of all the evidence were denied, and a verdict of guilty was returned by the jury.
