This was a petition filed September 7, 1907, praying for partition of a certain leasehold if capable of being partitioned with*269out great prejudice to the parties interested, otherwise that it he sold and the proceeds divided according to their respective interests. There was no dispute about the titles alleged, namely, that the plaintiff is entitled to 4-9 of the leasehold of certain lands at Makaha, Waianae, in the County of Oahu, under a lease of November 22, 1802, to John D.
