This is an appeal from a judgment of non-suit in an action for damages for malicious prosecution.

The plaintiff was engaged in the real estate business and also conducted an automobile parking station near Tenth and Hill Streets in the city of Los Angeles. In 1926 he sold the lot on which he was residing with his wife and daughter with the privilege of moving the house to another location. The house was moved to 1634-62nd Street.
