Appellee was duly appointed executor of the estate of John P. Parsons, deceased, by the probate court of Morgan county, Ala., and has since been in the active discharge of his duties as such executor. Subsequent to the probate o'f the will of said decedent in this state, one Myers was appointed by the county court of Livingston county, 111. (the domicile of the decedent at the time of his death), administrator of said estate with the will annexed in the state of Illinois, where the deceased owed certain debts.
