OPINION AND ORDER
SARGUS, District Judge.
This matter is before the Court upon motion of the Plaintiff State of Ohio Environmental Protection Agency (“State of Ohio”) for a preliminary injunction. (Doc. # 2). After the filing of Plaintiffs motion, Plaintiff further moved to consolidate the preliminary injunction hearing with the trial on the merits of this action. (Doc. # 4). The Motion being unopposed, this Court orally granted the same at a hearing held on November 6, 2000.
