Defendants New York City Health and Hospitals Corporation (NYCHHC) sued herein as Kings County Hospital Center and Dr. Susan Smith McKinney Nursing Rehabilitation Center move for an order dismissing the action pursuant to CPLR 3211 (a) (7) for failure to timely serve a notice of claim pursuant to General Municipal Law §§ 50-e and 50-i and section 7401 of the McKinney’s Unconsolidated Laws of NY and dismissing the complaint pursuant to CPLR 3211 (a) (5) for failure to comply with the statute of limitations.
