MEMORANDUM OPINION AND ORDER
ASPEN, District Judge:
The two remaining defendants, Community Bank of Greater Peoria and Community Financial Services, Inc. (collectively, “Community Bank”), originally moved to dismiss Count III of the complaint for failure to state a claim upon which relief could be granted. In response, the plaintiff Rosetta Heastie moved for summary judgment on liability for Count III.
